1. Acceptance of Terms
By accessing or using CIFER Security's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and CIFER Security ("CIFER," "we," "our," or "us") governing your use of our zero-key encryption infrastructure and related services.
2. Description of Services
CIFER provides encryption infrastructure services that enable secure data encryption and decryption without traditional key management. Our Services include:
- Zero-key encryption APIs and SDKs
- Access to Trusted Execution Environment (TEE) infrastructure
- Documentation and developer resources
- Customer support
3. Account Registration
To use certain features of the Services, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Infringe on intellectual property or privacy rights of others
- Transmit malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services or servers
- Engage in any activity that could damage, disable, or impair the Services
- Use the Services for illegal encryption of illicit content
5. Your Data
Ownership: You retain all rights to data you encrypt using our Services. We do not claim ownership of your encrypted content.
Technical Limitation: Due to our zero-key architecture, data encrypted through our Services can only be decrypted according to policies you specify. We cannot recover data if access policies are misconfigured or if authentication credentials are lost.
Your Responsibility: You are solely responsible for the content you encrypt and for ensuring appropriate access policies are configured.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Services. We may modify, suspend, or discontinue features with reasonable notice when possible. Scheduled maintenance will be communicated in advance.
7. Payment Terms
For paid Services, you agree to pay all applicable fees as described in your service agreement. Fees are non-refundable except as required by law or expressly stated in these Terms.
8. Intellectual Property
The Services, including software, documentation, and trademarks, are owned by CIFER and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services according to these Terms.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
While we implement strong security measures, no system is completely secure. We do not warrant that the Services will be error-free or that defects will be corrected.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIFER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO CIFER IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold CIFER harmless from any claims, losses, or damages arising from your use of the Services, violation of these Terms, or infringement of any rights of third parties.
12. Termination
We may suspend or terminate your access to the Services for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Services ceases immediately.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which CIFER is incorporated, without regard to conflict of law principles.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.
